Terms of Use
1. Parties
This Membership and Usage Agreement (hereinafter referred to as the “Agreement”) is electronically approved between ARAL OYUN KONSOL VE AKSESUAR A.Ş (“Aral”), located at Beşyol Mah. Akasya Sok. No:14 Florya / Küçükçekmece / İSTANBUL, which provides the services offered under the mipo.com.tr website, and the user ("User") who is a member of the www.mipo.com.tr website or uses the services offered under the website without being a member.
2. Subject of the Contract
This Agreement defines the terms of use for the services offered by the User under the domain name www.mipo.com.tr and its subdomains (“Website”), and the rights and obligations of the parties.
3. General Rights and Obligations
3.1 The User acknowledges, declares, and undertakes that all information provided during registration with the Aral system is accurate and complete, that they are solely responsible for any damages and penalties arising from the inaccuracy of this information, and that they will immediately and fully compensate Aral for any damages it may suffer in this regard. The User is responsible for the confidentiality of their unique username and password, and Aral shall not be held liable for any damages that may arise from these passwords falling into the hands of third parties due to the User's fault or negligence.
3.2 The User acknowledges, declares, and undertakes that, while using the Aral system and providing any content to the system, they comply with all applicable legislation in the Republic of Turkey, that this content is in accordance with general morality, and that it does not infringe upon any rights of third parties (personal rights, intellectual and industrial property rights, etc.); and that they will immediately and fully compensate Aral for any damages it may suffer as a result of their conduct to the contrary.
3.3 The User acknowledges, declares, and undertakes that the content (comments, articles, photos, videos, advertisements, etc.) provided by themselves or other Users on the Website belongs to the person who originally uploaded it, and therefore Aral has no responsibility or liability whatsoever for this content. Furthermore, the User acknowledges, declares, and undertakes that they are solely responsible for the content they provide and agree to indemnify Aral against any disputes and claims for damages arising therefrom.
3.4 The User acknowledges, declares, and undertakes that, in transactions requiring online payment methods and credit card use on the Website, transactions will be carried out only with the consent of the cardholder, and that the User will be solely responsible for all costs and damages, including attorney fees, arising from chargebacks.
3.5 The User acknowledges, declares, and undertakes that they will not engage in any actions that disrupt or hinder the operation of the Website (spam, viruses, Trojan horses, other malicious software, etc.) or be in contact with third parties who engage in such actions.
3.6 In the event of a breach of any provision of this Agreement by the User and/or upon request by the Information Technologies and Communications Authority, the Telecommunications Communication Presidency, or other authorities, Aral reserves the right to suspend, delete, and prevent the User from creating another account, as well as the right to claim compensation independently of these actions.
3.7 Without prejudice to the provisions of this Agreement, Aral reserves the right to unilaterally terminate the User's membership and delete files, documents, and information at any time. The User hereby consents to Aral's actions in this regard and declares and agrees that they will not claim any compensation from Aral for this reason.
3.8 The User acknowledges, declares, and undertakes that, for legal and commercial reasons, they consent to Aral storing information such as the name of their internet service provider and internet protocol (IP) address, the date and time of access, the pages accessed while on the site, and the address of the website that provided direct access to the site.
3.9 The User acknowledges, declares, and undertakes that their personal information may be used by Aral or its business partners for promotional, communication, and advertising purposes, and that they may receive emails and SMS messages regarding this matter, unless they explicitly state otherwise on the Website. Aral will make every effort to protect the confidentiality of this personal information, and Aral will not be held liable for any loss of this information to third parties.
3.10 Aral may disclose the User's personal data and information for legal reasons and/or upon request from official authorities, without requiring the User's prior consent.
3.11 Aral will make every effort to ensure the smooth operation of the Website, but does not guarantee that the system will operate without errors and will not be held responsible for the unauthorized reading of users' data or any damage that may occur to it. The user acknowledges and declares that Aral will not be held responsible for any damage that may arise from the use of the Website. Aral may, at its sole discretion, modify, delete, or temporarily or permanently suspend all or part of the Website or certain services.
3.12 The website may contain links or references to other websites that are not under Aral's control, and Aral is in no way responsible for the content of these sites or any links they contain.
3.13 Aral is the owner or licensee of all materials on the Website, including the general appearance and design of the Website, all information, images, trademarks, domain names, logos, icons, demonstrative materials, written, electronic, graphic or machine-readable technical data, computer software, sales system, business method and business model (“Materials”), and all intellectual and industrial property rights related thereto. No Material on the Website, including code and software, may be modified, copied, reproduced, translated into another language, republished, uploaded to another computer, posted, transmitted, presented or distributed without prior permission and attribution of source. The Website, in whole or in part, may not be used on another website without permission. Aral reserves all legal and criminal claims and all other rights not expressly stated herein for any actions to the contrary.
4. Amendment of the Contract
Aral reserves the right to change, reorganize, or discontinue any services, products, terms of use, and information offered on the Website without prior notice. Changes will take effect immediately upon publication on the site. By using or accessing the Website, you are deemed to have accepted these changes.
5. Termination of the Contract
This Agreement shall remain in effect until membership is cancelled by the User or Aral for any reason.
6. Dispute Resolution
In case of disputes relating to this agreement, the Istanbul Courts and Enforcement Offices shall have jurisdiction.
7. Entry into force
By registering as a member or beginning to use the services offered on the Website, the User deems it stipulated that they have read and approved all the terms of this Agreement.
